These Terms & Conditions (“Terms”) form a binding agreement between you and QUINPIN LLP, a limited liability partnership registered in India (“QUINPIN,” “we,” “us,” or “our”), governing your access to and use of Fistara, including fistara.ai and fistara.com (the “Service”). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Fistara is an AI companion platform that may provide AI chat, voice AI, AI search, AI memory, productivity features, and, in the future, AI agent capabilities that can take actions on your behalf. We may add, change, or remove features at any time.
You must be at least 13 years old, or have permission from a parent or legal guardian if required by local law, to use the Service. By using the Service, you represent that you meet this requirement.
Fistara offers Free, Pro, and Enterprise plans. All billing, subscriptions, and related legal obligations are handled by QUINPIN LLP. Paid subscriptions are processed through Stripe, PayPal, or Razorpay, depending on your location and payment method.
You agree to use the Service lawfully and responsibly. Detailed rules on prohibited conduct — including spam, illegal activity, malware, abuse, and automated scraping — are set out in our Acceptable Use Policy, which is part of these Terms. We may suspend or terminate access for violations.
Fistara is powered by artificial intelligence. AI-generated responses, including voice, chat, search results, and anything drawn from AI memory, may be incomplete, outdated, or incorrect. You are responsible for independently verifying any information you rely on for important decisions. Full detail on these limitations is set out in our AI Disclaimer, which is part of these Terms. Where Fistara offers agent capabilities that can take actions on your behalf, those actions require your review and approval before they are carried out, except where you have explicitly configured automatic execution.
You retain ownership of the messages, voice input, and other content you submit to the Service (“Your Content”). By submitting Your Content, you grant QUINPIN LLP a non-exclusive, worldwide license to host, process, and transmit it solely to operate, maintain, and improve the Service, consistent with our Privacy Policy.
The Service, including its software, design, branding, and the name “Fistara,” is owned by QUINPIN LLP and protected by intellectual property laws. Except for the limited rights expressly granted to you to use the Service, no other rights are granted.
The Service relies on third parties, including payment processors (Stripe, PayPal, Razorpay) and AI model providers. Your use of features backed by these providers may also be subject to their own terms. We are not responsible for the acts or omissions of independent third-party providers.
You may stop using the Service and delete your account at any time; see our Data Deletion Policy. We may suspend or terminate your access if you violate these Terms, the Acceptable Use Policy, or applicable law, or if we discontinue the Service, with notice where reasonably practicable.
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that AI-generated content will be accurate or reliable.
To the maximum extent permitted by applicable law, QUINPIN LLP and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service — including reliance on AI-generated content. To the extent any liability is not excluded, our total liability for claims relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim, or [AMOUNT] if you are on the Free plan.
You agree to indemnify and hold harmless QUINPIN LLP from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms.
These Terms are governed by the laws of India. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Uttar Pradesh, India.
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you directly. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
